General terms and conditions of sale

2 MAI PARIS, a société par actions simplifiée (simplified joint stock company), registered in the Paris Trade and Companies Register under number 920 627 742, having its registered office at 7, rue de l'Encheval, Paris (75019), France, whose intra-community vat number is FR07920627742 (hereinafter "2 MAI PARIS") designs, manufactures and markets mixed-use clothing made in France, based on the values of upcycling (hereinafter the "Pieces") via its website accessible at the following address: 2maiparis.com (hereinafter the "Site"), of which it is the publisher.

ARTICLE 1: SCOPE OF APPLICATION

These general terms and conditions of sale (hereinafter the "General Terms and Conditions of Sale") apply to any order placed remotely via the Site by an individual customer acting for non-professional purposes (the "Customer").

All orders for Pièces 2 Mai imply the Customer's unreserved and irrevocable acceptance of the Terms and Conditions of Sale. The Customer is invited to print or save a copy of the General Terms and Conditions of Sale, accepted at the time of any Pièces 2 Mai order by clicking on the "I have read and accept the general terms and conditions of sale" button.

2 MAI PARIS reserves the right to adapt or modify the General Terms and Conditions of Sale at any time. In the event of modification, the General Sales Conditions in force on the day of the order will be applied to each order.

The Customer acknowledges that he/she is of legal age and has full capacity to enter into commitments under the conditions set out in the General Terms and Conditions of Sale.

ARTICLE 2: ORDERING PROCESS

2 MAI PARIS does not deliver to all territories. The customer must check with 2 MAI PARIS whether distance selling is possible in the chosen country of delivery.

Any order of 2 Mai Parts from 2 MAI PARIS must be formalized by sending the order form provided for this purpose accessible on its Site.

Sales are perfected only after express acceptance by 2 MAI PARIS of the Customer's order and sending of an order confirmation by e-mail to the address indicated by the Customer, the Customer formally accepting the use of e-mail for the confirmation of his/her order by 2 MAI PARIS.

2 MAI PARIS reserves the right to refuse the execution of the order placed by the Customer for just cause, in particular in the event of abnormal character of this one, in the event of unavailable product, in the event of doubt concerning the solvency of the Customer, in the event of errors in the order (example: abnormal price of Product), in the event of suspicion of resale of Parts 2 Mai, or in the event of abnormal and abusive returns and exchanges.

ARTICLE 3: CHARACTERISTICS OF PARTS 2 MAY AND AVAILABILITY

In accordance with articles L. 111-1 et seq. of the French Consumer Code, the essential characteristics and prices of the Pièces 2 Mai sold electronically are available on the Site.

Each Product is described as accurately as possible using descriptive sheets and photos taken by 2 MAI PARIS. Nevertheless, despite all the care taken by 2 MAI PARIS, the photographs may not ensure a perfect similarity with the Product, particularly with regard to colors and the rendering of different materials. Differences may result from the color quality of the photographs. Under no circumstances may these differences be interpreted as defects in conformity, lead to the cancellation of the sale or incur the liability of 2 MAI PARIS. The Customer is invited to refer to the description of each Product to know its characteristics.

2 Mai Parts are offered for sale while stocks last. In the event of unavailability of the Product ordered, the Customer will be informed as soon as possible. They will then be offered the choice of modifying their order or cancelling it.

The 2 Mai 2 Mai pieces are made from recycled fabrics. Any small flaws in the fabric are part of its inherent beauty and history. The lining and ribbing, however, are new, for the sake of product longevity and optimal wearer comfort. The garments are made in Troyes, France, with the utmost care, ensuring the quality of Made in France. For Varsity jackets, only professional dry-cleaning is recommended. Do not clean with soap and water.

ARTICLE 4: RIGHT OF WITHDRAWAL

In accordance with the French Consumer Code, the Customer has a period of fourteen (14) calendar days from the date of receipt of the Product or collection of the Product to exercise his right of withdrawal without having to give reasons, the date shown on the carrier's receipt signed by the Customer being taken as proof.

To exercise his right of withdrawal, the Customer must notify his decision in the following manner.

Within the fourteen (14) days following the date of receipt of the Product, the Customer expressly notifies 2 MAI PARIS of his/her wish to exercise his/her right of retraction and to return the Product by completing the returns form (model appended to the General Terms and Conditions of Sale) and sending it by registered letter with acknowledgement of receipt, to the following address: 2 MAI PARIS, 7, rue de l'Encheval, Paris (75019), France, or by e-mail to the following address alice@2maiparis.com.

Upon receipt of the retraction request, an advisor will contact the Customer in order to carry out a quality control of the Product and will provide the Customer with a specific transport label to ensure the return of the Product.

RETURN SHIPPING COSTS ARE AT THE CUSTOMER'S EXPENSE.

In the event of exercising this right of withdrawal, the Customer shall return the Product to 2 MAI PARIS, by dispatching it within fourteen (14) days from the date of exercising the right of withdrawal under the following conditions:

- the Customer must enclose the completed and printed returns form with the parcel. No returns will be accepted without a duly completed returns form;

- 2 Mai Parts must be returned in their original packaging, with their label and any accessories, in perfect condition to the address indicated on the return label provided by 2 MAI PARIS.

FINALLY, IN THE EVENT OF PRODUCT DEPRECIATION RESULTING FROM HANDLING OTHER THAN THAT REQUIRED TO ESTABLISH THE NATURE AND CHARACTERISTICS OF THE PRODUCT, 2 MAI PARIS RESERVES THE RIGHT TO REFUSE TO REFUND OR EXCHANGE THE PRODUCT.

ARTICLE 5: DELIVERY OF PARTS MAY 2

The customer will choose the method of receiving the 2 Mai parts when placing the order.

The 2 Mai Parts will be delivered to the address indicated by the Customer.

For all deliveries, the costs are indicated at the time the order is placed and are payable by the Customer. No change of delivery address will be accepted once the order has been confirmed.

2 MAI PARIS will send the Customer the Colissimo tracking number so that he can follow the progress of his delivery in real time.

The estimated delivery time does not constitute a strict deadline and 2 MAI PARIS cannot be held liable to the Customer in the event of delay.

In the event of a delay of more than thirty (30) days from the date of the order, the Customer is invited to contact 2 MAI PARIS' customer service department using the contact details specified in Article 14 "Complaints", and may choose to set a new delivery date or cancel the sales contract. In the event of cancellation, the Customer will be reimbursed in accordance with article L. 216-2 of the French Consumer Code.

The risks of loss and deterioration of the 2 Mai Parts are transferred to the customer at the time of delivery to the address indicated on the order form.

In the event of delivery, the unloading of 2 Mai Parts is the sole responsibility of the Customer, even when the carrier is involved. The customer must check the condition of the packaging upon delivery and report any damage or missing Products within seven (7) working days.

Any erroneous or missing mention, and necessary, in the delivery address and the identity of the Customer discharges 2 MAI PARIS from responsibility for the delivery.

In the case of a return for an incomplete address (e.g. missing residence, building, company, etc.), the cost of resending the parcel will be charged to the Customer.

ARTICLE 6: PRICES

The prices of Pièces 2 Mai sold are those in force on the day of the order, as indicated on the order form. The prices of Pièces 2 Mai are denominated in euros and will be increased by the applicable VAT rate.

Prices do not include delivery charges, which are indicated to the Customer at the time of ordering.

Taxes, customs duties and other compulsory fees, as well as any bank charges, shall be borne by the Customer.

2 MAI PARIS reserves the right to modify its prices at any time. However, 2 MAI PARIS undertakes to invoice the 2 Mai Parts ordered at the prices indicated when the order is registered.

An invoice is issued and sent to the customer with each order, summarizing the price of the order and the additional costs of processing the order and shipping the 2 Mai Parts.

ARTICLE 7: PAYMENTS

Payment for orders is made via a secure payment platform chosen by the Customer (Stripe(www.stripe.com), Alma, Google Pay, at the time of order confirmation.

 

The payment methods that can be used are indicated on the Site during the order process: Visa, Mastercard, AmEx bank cards.

 

When paying by credit card, the Customer must enter his/her card number, expiry date and the security code on the back of the card. The Site will ask the Customer if he/she wishes to keep this information for future purchases via the Site. The Customer may refuse to keep this information and, if he agrees, may delete it at any time via his account accessible on the Site.

 

2 MAI PARIS reserves the right to refuse to honor an order from a customer who has not paid all or part of a previous order or with whom a payment dispute remains.

 

Payment for orders is made through the services of our payment service providers. 2 MAI PARIS is therefore in no way responsible for the processing of banking data or data concerning the credit card, by which the payment in question is made.

 

In the event of non-payment, incorrect address or any other problem with the Customer's account, 2 MAI PARIS reserves the right to block the Customer's order until the problem is resolved.

 

In the event of fraudulent use of his/her bank card, the Customer is invited to contact 2 MAI PARIS by e-mail at the following address: alice@2maiparis.com

 

Any complaints concerning invoiced amounts must be made in writing by the Customer immediately after receipt of the invoice concerned, to the address indicated inArticle 14 " Complaints ".

ARTICLE 8: RETENTION OF TITLE

2 MAI PARIS retains ownership of the 2 Mai Parts ordered until full and effective payment of the price, and reserves the right to suspend delivery in the event of late payment until the debtor's account has been settled in full.

ARTICLE 9: LEGAL WARRANTIES

- Warranty of conformity

2 MAI PARIS guarantees the conformity of 2 Mai Parts for a period of two years from the date of delivery, in accordance with articles L.217-4 et seq. of the French Consumer Code.

THE WARRANTY COVERS ALL MANUFACTURING DEFECTS AND DOES NOT COVER DAMAGE CAUSED BY MISHANDLING OF 2 MAI PARTS, MISUSE, ACCIDENTS, WATER, SOLVENTS, WEAR AND TEAR, DAMAGE CAUSED BY TRANSPORTERS OR DAMAGE CAUSED BY THIRD PARTIES AND NOT ATTRIBUTABLE TO DEFECTS IN 2 MAI PARTS.

When the legal guarantee of conformity is invoked, 2 MAI PARIS undertakes to:
- either repair the Product or replace it with an identical product in terms of available stocks, at the Customer's discretion;
- or refund the price of the Product if repair and replacement prove impossible.

- Warranty for hidden defects

The Customer may decide to invoke the warranty against hidden defects in the item sold, as defined in articles 1641 to 1648 and 2232 of the French Civil Code. In this case, the Customer may choose between (i) rescission of the sale, with return of the Product and reimbursement, or (ii) retention of the Product and a reduction in the sale price, in accordance with article 1644 of the French Civil Code.

No conventional warranty applies to sales of Pièces 2 Mai.

- Implementation

In the event of a lack of conformity or in the event of latent defects observed by the Customer which should lead to a return, the Customer shall inform 2 MAI PARIS, by registered letter with acknowledgement of receipt to the following address: 2 MAI PARIS, 7, rue de l'Encheval, Paris (75019), France, or by e-mail to the following address alice@2maiparis.com or to any other address indicated by 2 MAI PARIS.

2 MAI PARIS will proceed with a qualitative and quantitative verification of the 2 Mai Parts purchased. After validation, 2 MAI PARIS will provide the customer with a specific transport label to ensure the return of the 2 Mai Parts. In the case of non-conformity or hidden defects, 2 MAI PARIS will be responsible for shipping costs.

ANY INTERVENTION, MODIFICATION OR TRANSFORMATION OF THE PRODUCT BY THE CUSTOMER OR A THIRD PARTY ON GUARANTEED 2 MAI PARTS INVALIDATES ANY CLAIM AGAINST 2 MAI PARIS.

ARTICLE 10: AVAILABILITY OF THE SITE

Customers are informed of the technical hazards inherent in telecommunication networks and the Internet, and of access interruptions which may result therefrom or from its own service providers or third-party service providers. 2 MAI PARIS is therefore unable to guarantee the continuity of the Site, executed remotely, via the Internet or any telecommunication network, which the Customer acknowledges.

2 MAI PARIS will not be held responsible for any unavailability or slowdown of the Site due to slowdowns or malfunctions of communication networks or third-party service providers.

2 MAI PARIS in no way guarantees that the Site is secure, free of bugs or viruses. It is the customer's responsibility to take all necessary measures to protect his or her computer system against contamination by potential viruses and against any attempt at intrusion by third parties.

ARTICLE 11: INTELLECTUAL PROPERTY RIGHTS

The Pièces 2 Mai by 2 MAI PARIS are original creations and works and benefit from intellectual protection and respect for their author's rights. They may not be reproduced or modified.

2 MAI PARIS is the exclusive owner of the rights to its websites, in particular all texts, comments, works, illustrations, videos and images, whether visual or sound, reproduced on the Site.

2 MAI PARIS is also the owner of trademarks registered by 2 MAI PARIS.

All these elements are protected by copyright, trademark law, patent law, sui generis database law and image rights, worldwide.

In this respect and in accordance with the provisions of the French Intellectual Property Code, only the use of the Site or the Pièces 2 Mai for private use, subject to different or even more restrictive provisions of this code, is authorized.

Any other use constitutes counterfeiting and is punishable by law.

ARTICLE 12: FORCE MAJEURE

2 MAI PARIS will be exonerated from all liability in the event of a total or partial breach, even temporary, of one or other of its obligations, which would be caused by a case of force majeure.

 

Force majeure is defined as an event of an insurmountable and irresistible nature, resulting from an event outside the control of the Parties, which consists of an event or series of events meeting the definition of force majeure within the meaning of article 1218 of the French Civil Code.

 

The following events are also considered to be cases of force majeure: floods, fires, total or partial strikes, lock-outs (including strikes and lock-outs affecting 2 MAI PARIS directly or indirectly), epidemics, blockage of means of transport or any other reason, earthquakes, storms, water damage, governmental or legal restrictions, computer breakdowns, telecommunications blockages.

 

The Customer may not invoke such events to cancel the order or withhold payment of invoices. May 2 Parts ready for delivery at the time of the event must be accepted by the Customer and paid for.

ARTICLE 13: PERSONAL DATA

In connection with the sale of 2 Mai Parts, 2 MAI PARIS collects and processes certain personal data about the Customer, including the Customer's first and last name, telephone number, address and e-mail address (the " Data ").

 

2 MAI PARIS ensures that the Customer's Data is collected and processed in compliance with the provisions of the French Data Protection Act n°78-17 of January 6, 1978 (amended by Act n°2004-801 of August 6, 2004, Act n°2016-1321 of October 7, 2016, law n°2018-493 of June 20, 2018 and order n°2018-1125 of December 12, 2018) (the " Loi Informatique et Libertés ") and Regulation n°2016/679 of the European Parliament and of the Council of April 27, 2016 (the " Regulation ") as well as any applicable laws or regulations regarding Data protection in connection with the Sale of Pièces 2 Mai, and in accordance with its privacy policy.

 

The Privacy Policy is an integral part of the General Terms and Conditions of Sale.

 

Customers are invited to consult the Privacy Policy, to which they are referred for a more detailed description of the conditions under which Customer Data is collected and processed.

 

Under the provisions of the French Data Protection Act (Loi Informatique et Libertés) and the Regulation, customers have the right to access, rectify, delete, limit or oppose the processing of their Data, the right to define directives concerning the retention, deletion and communication of their Data after their death, and the right to the portability of their Data.

2 MAI PARIS is committed to guaranteeing the existence of adequate levels of protection in accordance with applicable legal and regulatory requirements. However, as no mechanism offers absolute security, a certain amount of risk remains when the Internet is used to transmit Data.

2 MAI PARIS will notify the CNIL and/or the Customer concerned of any Data breaches covered by the Regulation.

ARTICLE 15: GENERAL PROVISIONS

Language - The French version of these Terms and Conditions shall prevail over any translated version.

Partial invalidity - If one or more stipulations of the General Terms and Conditions of Sale are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.

Non-waiver - Unless otherwise stipulated, the fact that 2 MAI PARIS or the Customers do not claim from the other party a breach of any of the obligations referred to in the General Terms and Conditions of Sale shall not be interpreted for the future as a waiver of the obligation in question.

Applicable law - The General Terms and Conditions of Sale and the sales contracts concluded with the Customer are subject to French law.

Varsity Jacket

The Varsity Jacket 2 Mai is a mixed model.

Size 1 : it is a small size for small and feminine sizes. It corresponds to a size S for women classic in the trade.
Size 2: it is an intermediate size, it corresponds to a size M for women classic in the trade.
Size 3: it corresponds to a size M for men classic in the trade and a size L for women.
Size 4: it corresponds to a size L for men classic in the trade.
Size 5: it corresponds to a size XL for men classic in the trade.

T-Shirts

The 2 Mai T-shirts are mixed models.

Size 1 : it is a small size intended for small and feminine sizes. It corresponds to a size S for women classic.

Size 3: it corresponds to a size L for men classic in trade and a size XL for women.

The 2 Mai dresses are mixed models. They are straight and have a midi length. They can be worn as long t-shirts for men.

Size 2: it is an intermediate size, it corresponds to a size L for women classic and a size M for men.
Size 3: it corresponds to a size L for men classic in trade and a size XL for women.

Jogging

Size 1: this is a size that corresponds to a size S for women. The shirt can be worn open over a t-shirt or closed.

Size 3. It is a large size L for men and a size XL for women.
The shirt can be worn open over a t-shirt or closed.
It can be worn without problem for smaller sizes in an oversized way.
